Welcome to Drip Rewards ("Service"), a digital loyalty card platform operated by Crewstake Pty Ltd (ABN 54671816087), located at Level 1/57 Berwick St, Fortitude Valley QLD 4006 ("Company", "we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

1. Definitions

  • "Business" refers to merchants, cafes, restaurants, or other establishments that use our platform to operate loyalty programs.
  • "Customer" refers to individuals who participate in loyalty programs through our platform.
  • "Loyalty Program" refers to the rewards system set up by a Business using our Service.
  • "Stamps" or "Points" refers to the digital credits earned by Customers through visits or purchases.

2. Service Description

Drip Rewards provides a digital loyalty card platform that enables:

  • Businesses to create and manage digital loyalty programs
  • Customers to collect stamps/points and redeem rewards via their mobile phone number
  • Businesses to send promotional SMS messages to opted-in customers

3. Account Registration

3.1 Business Accounts

Businesses must provide accurate information during registration, including business name, contact details, and payment information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Customer Participation

Customers participate in loyalty programs by providing their phone number. By doing so, you consent to:

  • Receiving SMS notifications about your loyalty status
  • Receiving promotional messages from participating businesses (you may opt out at any time)
  • Storage of your phone number and loyalty activity data

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the Service
  • Submit false or misleading information
  • Abuse or exploit loyalty programs in ways not intended
  • Send spam or unsolicited messages through our platform

5. Loyalty Programs

5.1 Program Terms

Each Business sets their own loyalty program terms, including:

  • Number of visits/stamps required for rewards
  • Reward descriptions and values
  • Promotional offers and validity periods

5.2 Reward Redemption

  • Rewards must be redeemed according to the Business's terms
  • We are not responsible for the fulfillment of rewards by Businesses
  • Stamps/points have no cash value and cannot be transferred
  • Businesses may modify or discontinue their programs at any time

6. Payments and Billing

6.1 Business Subscriptions

Businesses agree to pay applicable subscription fees as outlined in our pricing. Payments are processed securely through Stripe. All fees are non-refundable unless otherwise stated.

6.2 Free Trial

New Business accounts may be eligible for a free trial period. Trial terms are specified during registration.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

8. Intellectual Property

The Service, including its design, features, and content, is owned by Crewstake Pty Ltd. You may not copy, modify, or distribute any part of the Service without our written permission.

9. Third-Party Services

Our Service integrates with third-party providers including:

  • Stripe for payment processing
  • Neon for database services
  • Vercel for hosting and infrastructure
  • Resend for email communications

Your use of these services is subject to their respective terms and conditions.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:

  • Uninterrupted or error-free service
  • The accuracy of data provided by Businesses
  • The quality or availability of rewards offered by Businesses

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREWSTAKE PTY LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless Crewstake Pty Ltd from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination:

  • Businesses lose access to their dashboard and customer data
  • Customers lose accumulated stamps/points with terminated Businesses

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify registered users of material changes via email.

15. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes shall be resolved in the courts of Queensland.
